Terms and Conditions
  
1.  Your private information will not be distributed in any way over the Internet and there will be absolutely no commercial dissemination of private information without your prior consent, except to the extent necessary to comply with applicable laws or in legal proceedings where such information is relevant.
 
2.  By using this service, you agree to release the city and/or county where the violation occurred, the court and its personnel, as well as eZCourtPay, LLC, its employees, agents, servants, officers, directors, affiliated companies, successors and assigns (collectively the �Providers�) from any and all causes of action sounding in contract or negligence based upon the information provided to you or the court or distributed to you or the court.
 
3. The Providers will use all reasonable efforts to provide accurate processing of information provided from the court files and to diligently distribute information provided by the User to the court.
 
4. The Providers cannot and do not guarantee the accuracy or timeliness of any provided information and expressly disclaim any warranty including merchantability and fitness for a particular use beyond the extent of the filing fees paid by the User for the service. In no event shall Providers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with the use of this program or with the delay or inability to use it (or any linked sites), or for any information, software, products and services obtained through this program, or otherwise arising out of the use of this program, the Internet generally or on any other basis (whether based on contract, tort, strict liability or otherwise).
  
  5. You agree to allow eZCourtpPay to send text messages and/or emails when the citation(s) is available and/or has been paid.
       
6. You agree not to challenge the use of any electronic payment, and additionally agree that any action brought by the Providers against you to enforce any electronic payment for which any benefit has been provided to you in any way shall entitle the Providers to per se probable cause for criminal action for theft of services or for civil recovery of all fees paid, plus convenience fees, plus costs, plus attorney fees, plus any incidental or associated damages proven by the Providers. Any such civil actions shall be brought in the courts of Cherokee County, Georgia, without regard to choice of law, and all parties consent to jurisdiction and venue therein.
 
7. If You are making an electronic payment to post a cash bond, you still have the right to appear in Court on your arraignment date as stated on your citation(s). Otherwise, this payment, in lieu of an appearance, will be accepted by the Court as satisfactory payment for the offense(s) in question.
  
8. Your participation in this process and the authorization you are providing via electronic signature will be construed to be the same as you appearing in person at the court to make your payment.
     
  9. Nothing herein is to be construed as legal counsel or advice. Users should consult with their own legal counsel with respect to the implications of making the payment through this system.
 
10. By submitting payment you are affirming you are legally authorized to make purchase on the credit card associated with this transaction.
 
11. The Providers will store your email address and/or phone number for up to 90 days from the date it was made available.
 
12. Please note � eZCourtPay does not process refunds of any type once payment has been submitted/confirmed.
 
Note: If your citation is paid after your court date, the court may have already sent notice of your failure to appear in court to the Department of Driver Services and additional steps may be required to release your license.
